Privacy Policy

This Privacy Policy describes the types of information that may be collected and the manner in which any such information is collected and used by Rave Wireless, Inc. ("Rave") in connection with the services and applications offered by Rave either directly or in conjunction with Clients who have contracted with Rave to provide services to their constituents (e.g., employees, students, citizens, etc.).

The disclosure of personally identifiable information ("PII") is a sensitive and serious issue, and Rave considers it imperative to protect the privacy of registrants ("Members"). Therefore, Rave will collect and use PII in accordance with the terms of this Privacy Policy and for the purpose of enabling you to get the maximum benefit from Rave's services, the Rave website and any website maintained by Rave for a Client (the "Sites").

1. Registration

In order to register as a Member, you must provide certain PII. The nature and amount of PII you are required to provide will depend upon the Rave service for which you are registering. The PII may include information such as your name, street address, phone number, fax number, email address, instant messenger identity, Client, school, institution or company affiliation, username, password, and other information that you or the Client make available to Rave. All such PII will be stored on Rave's computers and will be subject to this Privacy Policy. Rave owns or otherwise controls the servers that process and store PII and any messages, images, profiles, reviews, listings, or any other content ("Content") that you publish, display, or otherwise transmit directly or indirectly ("Post") on the Sites, in whatever form. Rave will endeavor to use reasonable efforts and standard industry practices to keep PII confidential and to protect it from unauthorized use. The security measures employed by Rave are described in Section 8 hereof. However, Rave may share PII with a third party as set forth in Section 3 hereof, and, at a Client's request, Rave may share PII with a Client. PII shared with a Client will be governed by the Client's privacy policies.

2. Your Profile

2.1 You will be asked to create a Member account ("Account"). If you choose to do so, your Account may be configured to enable you to be identified by others as you use the Sites.

2.2 Your Account will generally include information regarding your wireless phone number and your wireless carrier or any other contact information you provide.

2.3 Your email address is used to identify you in Rave's system as a unique user and to contact you in connection with your activities on the Sites (including, but not limited to, confirmation emails or important news affecting your relationship with your school or company, if applicable). It may also be used to gather feedback via surveys to enable Rave to improve the Sites according to your needs and to forward messages to you from other Members.

2.4 Rave may use aggregated Member data for external purposes (such as reporting total monthly messaging volume utilizing Rave services) and internal purposes (such as maintenance of Rave software used in connection with the provision of its services); provided that such information shared with third parties will be aggregated in a manner that prevents Member PII from being identified to, or associated with, a particular Client or Member.

3. Third Parties

Rave will not disclose your PII to third parties, except as follows or otherwise set forth in this Privacy Policy:

a) if disclosing your PII is reasonably necessary to execute a specific request by you or a Client (e.g., your wireless phone number may be submitted to other service providers in order to transmit messages that you send or receive) or in connection with third-party services provided to or on behalf of Rave (e.g., certain PII may be disclosed to or accessible by a company servicing Rave's computer systems or administering the Sites). In these cases Rave attempts to ensure, including through the use of confidentiality agreements, obligations or policies, that the third parties will not use, disclose or store any PII except to provide the specific services requested by you or Rave;

b) if Rave believes in good faith that such disclosure is reasonably necessary to: (a) comply with (i) any law or regulation, (ii) a judicial or criminal proceeding or investigation, (iii) a court order or legal process served on Rave or a Client, (iv) a Client's internal proceedings or investigations for alleged violations of the Client's policies or codes of conduct, or (v) an agreement between Rave and a third party service provider or Client; (b) to enforce the Terms of Use that govern your use of Rave's services and the Sites (the "Terms of Use"); (c) to respond to claims that the Content you post violates the rights of third parties; or (d) to protect the rights, property or personal safety of a Client, Rave, the wireless carrier providing access to the Services, other Members or the public;

c) if permitted by the Terms of Use;

d) if Rave sells assets or is acquired by or merges with another entity, in which event your PII may be disclosed to the acquiring or successor company; or

e) if you give Rave explicit permission to disclose your PII.

Rave is not be responsible for the actions or inactions of any third party to whom or to which PII is disclosed as permitted herein, including without limitation the disclosure or use of your PII by such third party. We do not now and do not intend to sell, rent or market PII to third parties.

4. Links

You may occasionally see on the Sites links to other websites posted by Members. Rave is not responsible for the privacy practices of other websites you may visit through a link you found on the Sites. If you provide information directly to a party other than Rave, different privacy policies may cover that party's use of your information. Please review any third party's privacy policy before disclosing your PII to that party.

5. Cookies and Log Files

The Sites may use cookies and web log files, including IP addresses, to track Member usage on an aggregate and anonymous basis or to help diagnose problems with Rave's server or to administer its services.

6. Children

The Sites will not knowingly provide access to the Sites to persons under the age of eighteen (18) without parental consent. If Rave learns that a Member is under the age of eighteen (18) and does not have parental consent, appropriate steps may be taken to remove the Member's PII from the database and restrict the individual from future access to the Sites. Any registration by, use of or access to the Sites by anyone under 13 is unauthorized, unlicensed and in violation of Rave's Terms of Use.

7. Transborder Hosting and Transfer of Information

PII may be transferred from time to time to Rave offices located throughout the world, including offices located outside the European Economic Area, and the Sites may be viewed and hosted anywhere in the world, including countries (such as the United States) that may not have laws regulating the use and transfer of PII. By using the Sites and submitting such information on it, you voluntarily consent to such transborder transfer and hosting of such information.

8. Security

Rave has implemented security measures to protect Member PII from loss, misuse and alteration. Rave uses practices that it believes are industry-standard, such as encrypted storage, firewalls and password protection systems, to safeguard the confidentiality of your PII. Passwords are encrypted and hidden from System Administrators, and other types of PII may be encrypted using industry best practices. Only authorized Rave personnel are permitted to access PII, and these personnel are required to treat this PII as confidential. Despite these precautions, it is not possible to guarantee the security of PII, including PII stored on a computer or transmitted over the internet, a computer network, or by wireless carrier. Accordingly, Rave cannot guarantee that unauthorized persons will not obtain access to PII.

9. You Have Control Over Your Personal Information

You can change your PII stored on the Sites at any time, whether it be the information supplied at registration (with the exception of your username), as part of your Profile or Account, or anything else. You may change information in, as applicable to your Rave service, the "My Profile", and/or "My Account" areas. In some cases, the Client may provide certain PII to Rave on a Members behalf. Members may contact the Client to request changes to PII supplied to Rave by the Client.

At any time you may stop SMS messages from being sent to your phone by simply texting STOP to 67283 or 226787 from your registered mobile phone. You will no longer receive messages from the Rave services. Text INFO or HELP to 67283 or 226787 from your registered mobile phone and you will be sent a text message with simple instructions.

10. Changes to this Privacy Policy

Rave may update this Privacy Policy at any time. The latest version of the Privacy Policy will always be available here and the most recent revision date will be indicated at the top of this page.
